Schedules of
Condition & Dilapidation

Schedule of Condition

A Schedule of Condition is a detailed report about a building's structure, materials, and overall state of repair at a set point in time. These accurate records provide essential reference points when reviewing any subsequent changes.

A Schedule of Condition is typically included in a lease to minimise any later disputes about the property's condition when the tenancy started.

Schedule of Condition - key points

  • Provides a detailed report on the condition of a property
  • Often used alongside council leases and commercial leases
  • Forms an integral aspect of party wall agreements
  • Applies to both commercial and residential properties

Schedule of Dilapidation

Usually towards the end of a commercial lease, a Schedule of Dilapidation is created on the landlord's behalf. This schedule details the current condition of the property and includes a list of items to be repaired by the tenant under the terms of the lease. It often includes an estimate of the costs of such remedial works.

A Schedule of Dilapidation may also be conducted during a tenancy to assess how well a property is being maintained and to issue repair notices if required.

Schedule of Dilapidation - key points

  • Ascertains the condition of a property under lease
  • Suitable for interim, terminal, and final tenancy reports
  • Applies only to commercial leases
  • Usually instructed by solicitors acting for the freeholder/landlord
